These Terms and Conditions govern access to and use of https://avidpeptides.com, including its content, accounts, ordering functions, products, and related services (collectively, the Services). In these Terms, Avid Peptides, we, us, and our refer to Avid Peptides.
By accessing the Services, creating an account, or submitting an order, you confirm that you have read, understood, and agree to these Terms, our Privacy Policy, Refund Policy, Shipping Policy, and Disclaimer. If you do not agree, do not use the Services or purchase products.
All products are offered solely as laboratory materials for legitimate research, analytical, or development purposes. They are not for human consumption, human or veterinary administration, clinical use, diagnostic use, therapeutic use, food use, household use, or use in cosmetics or medical devices.
Products are not medicines, dietary supplements, foods, or cosmetics. Nothing on the Services is an instruction, recommendation, or invitation to use a product in or on a human or animal. You may not purchase or use a product for self-experimentation or for any purpose prohibited by these Terms or applicable law.
You must be at least 21 years old and legally capable of entering a binding contract. By ordering, you represent and warrant that you are a qualified researcher or are acting for a legitimate laboratory, educational, industrial, or research organization; that you understand the characteristics and hazards of the products purchased; and that you have appropriate facilities, equipment, training, procedures, and supervision for their receipt, storage, handling, and disposal.
You are solely responsible for determining whether your purchase, possession, transport, storage, use, transfer, and disposal of a product are lawful in your jurisdiction. We may request identity, age, institutional, intended-use, or other compliance information and may reject or cancel an order when we cannot verify eligibility or lawful research use.
You must provide accurate and current account information. You are responsible for maintaining the confidentiality of your credentials and for activity under your account. Notify us promptly at info@avidpeptides.com if you suspect unauthorized access. We may suspend or terminate an account for suspected fraud, misuse, policy violations, or legal or safety concerns.
An order is an offer to purchase. An automated confirmation acknowledges receipt but does not constitute acceptance. We may accept, reject, limit, hold, or cancel an order before shipment for inventory, pricing, payment, fraud, compliance, safety, geographic, or other legitimate business reasons.
If we cancel an order after payment is captured, we will return the amount charged for the canceled item or order to the original payment method, subject to processing times outside our control. Products, packaging, lot numbers, and availability may change without notice.
Prices are stated in U.S. dollars unless otherwise indicated and may change without notice. You are responsible for applicable taxes, shipping charges, duties, fees, and address-correction charges shown at checkout or imposed by law. You authorize us and our payment processors to charge the payment method submitted for all amounts due.
We may correct pricing, description, inventory, or system errors and cancel affected orders. If an order is canceled because of our error after payment, the amount charged for the canceled portion will be returned to the original payment method.
Product descriptions, images, and general scientific information are provided for identification and research reference only. Lot-specific characteristics are controlled by the applicable label and Certificate of Analysis. Images may not depict the exact lot or packaging received.
Any statement concerning identity, purity, testing, sterility, endotoxin, quantity, or other specification applies only when supported by the current lot-specific Certificate of Analysis or other written documentation. You remain responsible for independently determining that a product and its documentation are suitable for your research and for performing any additional qualification your protocol requires.
Shipping is governed by our Shipping Policy. Delivery dates are estimates, not guarantees. To the extent permitted by law, title and risk of loss pass to you when the carrier accepts the shipment, except where our Shipping Policy or applicable law provides otherwise. You must inspect the shipment promptly and report qualifying issues within the time stated in the Refund Policy.
Returns, replacements, credits, refunds, and cancellations are governed by our Refund Policy. Because product identity and storage conditions cannot be verified after delivery, products ordinarily cannot be returned to inventory and all sales are final except for the limited circumstances stated in that policy or as required by law.
You may not use the Services or products to violate law; administer or apply a product to a human or animal; make medical, diagnostic, or therapeutic use of a product; resell, repackage, relabel, redistribute, or export a product without our prior written approval; misrepresent your identity, qualifications, affiliation, intended use, or destination; interfere with site security or operation; scrape or copy content through automated means contrary to our instructions; or infringe the rights of Avid Peptides or another party.
The Services, including text, design, graphics, photographs, logos, product presentation, software, and compilation, are owned by or licensed to us and are protected by applicable intellectual-property laws. We grant you a limited, revocable, nonexclusive, nontransferable license to use the Services for lawful evaluation and purchase of research materials. No other right or license is granted.
The Services may rely on third parties for hosting, analytics, payments, fraud prevention, communications, and shipping, and may link to third-party websites. We do not control and are not responsible for third-party content, availability, security, or privacy practices. Your use of a third-party service may be governed by that provider's terms.
You consent to receive transactional communications electronically, including order confirmations, receipts, security notices, and shipping updates. Marketing email or text messages will be sent only as permitted by law and your choices. Marketing consent is not a condition of purchase. You may unsubscribe from marketing email using the link provided and opt out of marketing texts by replying STOP. Reply HELP for help. Message frequency varies; message and data rates may apply.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND PRODUCTS ARE PROVIDED AS IS AND AS AVAILABLE. WE DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR FREE OR THAT A PRODUCT WILL BE SUITABLE FOR A PARTICULAR EXPERIMENT OR OUTCOME.
Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AVID PEPTIDES AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL, ARISING FROM THE SERVICES OR PRODUCTS, EVEN IF ADVISED THAT SUCH DAMAGES MAY OCCUR.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING FROM A PRODUCT OR ORDER WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. These limitations do not apply where prohibited by law or to liability that cannot lawfully be limited.
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Avid Peptides and its owners, officers, employees, contractors, and agents from claims, liabilities, losses, damages, judgments, costs, and reasonable attorneys' fees arising from your unlawful or prohibited use of a product or the Services, your breach of these Terms, your negligence or misconduct, or your violation of another person's rights.
We are not responsible for delay or failure caused by events beyond our reasonable control, including carrier disruption, severe weather, fire, flood, public-health events, labor disputes, governmental action, utility or network failure, shortage, or supply-chain interruption.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Any court proceeding must be brought in the state or federal courts located in Harris County and Texas and each party consents to their jurisdiction and venue. This section does not prevent either party from seeking relief in small-claims court where eligible or exercising rights that cannot legally be waived.
We may update these Terms by posting a revised version and effective date. Changes apply prospectively unless law requires otherwise. We may restrict or terminate access for violation of these Terms or to protect safety, security, legal compliance, or the integrity of the Services.
If any provision is held unenforceable, it will be enforced to the greatest lawful extent and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. These Terms and incorporated policies are the entire agreement concerning the Services and products, except for a separate written agreement signed by an authorized representative.
